1. Parties

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Onbit Media SRL, a company incorporated in Romania (CUI RO37027072), with registered address at Bd. Oituz, Nr. 13, Onești, Bacău, Romania ("Onbit", "we", "us", "our").

2. Description of Service

Onbit Backup is a cloud backup service for WordPress websites, delivered as a WordPress plugin ("Plugin") in combination with a remote API and storage infrastructure ("Service"). The Service enables Users to create, store, and restore backups of their WordPress installations.

The Service is provided on a subscription basis (Free and paid plans) and is available worldwide, to any natural or legal person who meets the eligibility requirements below.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age;
• Have the legal capacity to enter into binding contracts in your jurisdiction;
• Provide accurate, complete, and current registration information;
• Use the Service only for lawful purposes and in accordance with these Terms.

If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

4. Account Registration and Security

You must register an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@onbit.ro of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently, abusively, or in violation of these Terms.

5. Acceptable Use

You agree not to use the Service to store, transmit, or back up content that:

• Violates any applicable law or regulation;
• Infringes the intellectual property rights of any third party;
• Contains malware, ransomware, or other malicious code;
• Is obscene, defamatory, or otherwise unlawful.

You are solely responsible for the content of the WordPress installations you back up. Onbit does not inspect, filter, or moderate backup content.

6. Subscription, Payment, and Refunds

Paid plans are billed annually. All payments are processed exclusively by Stripe, Inc. in accordance with Stripe's own terms of service. Onbit does not store payment card data.

Subscription fees are stated in EUR and are non-refundable, with one exception: if you have not used any backup or restore operation during the billing period, you may request a refund within 14 days of the initial purchase by contacting support@onbit.ro. We reserve the right to decline refund requests where we determine that the Service has been materially used (including, but not limited to, successful backup creation, data download, or site restoration/migration).

We reserve the right to change subscription prices with at least 30 days' notice by email. Continued use of the Service after a price change constitutes acceptance of the new price.

7. No Warranty — Service Provided "As Is"

We do not warrant that:

• The Service will be uninterrupted, error-free, or available at any particular time;
• Backups will be complete, accurate, or restorable;
• The Service will meet your specific requirements;
• Any data stored through the Service will be protected against all possible forms of loss, corruption, or unauthorised access.

8. No Service Level Agreement (SLA)

We do not guarantee any specific uptime, availability, response time, or performance level for the Service. The Service is operated on a best-effort basis. We will make commercially reasonable efforts to maintain service availability, but we make no binding commitments regarding availability metrics.

Support is provided by email at support@onbit.ro on a best-effort basis, with no guaranteed response times.

9. Limitation of Liability

• Loss, corruption, or inaccessibility of backup data, whether caused by hardware failure, software error, human error, network issues, or any other reason;
• Website downtime, lost revenue, or business interruption resulting from failed or unavailable backups or restores;
• Incomplete, inaccurate, or non-restorable backups;
• Unauthorised access to your data despite reasonable security measures;
• Any failure or delay in the provision of the Service.

In any case, our total cumulative liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the amount actually paid by you for the Service in the three (3) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. To the extent that applicable law does not permit such exclusions, those exclusions shall apply only to the maximum extent permitted by law.

10. Data Responsibility

You are solely responsible for:

• Verifying that backups are complete and restorable before relying on them;
• Maintaining independent copies of critical data;
• Ensuring that the use of the Service complies with applicable data protection laws with respect to any personal data included in your WordPress installation;
• Obtaining any necessary consents from third parties whose data may be included in your backups.

Onbit Backup is a supplementary tool and should not be your sole means of data protection. We strongly recommend maintaining additional independent backups.

11. Intellectual Property

The Onbit Backup Plugin is licensed under the GNU General Public License v2.0 or later. The Service infrastructure, API, branding, and associated software remain the exclusive property of Onbit Media SRL. These Terms do not grant you any rights in the Onbit brand, trademarks, or proprietary systems beyond what is necessary to use the Service.

12. Termination

You may cancel your account at any time from the Client Portal. Upon cancellation, your backup data will be deleted from our production servers immediately. Backup copies held in our infrastructure-level backup systems may be retained for up to 30 days, after which they are permanently deleted.

We may suspend or terminate your account with or without notice if you breach these Terms, if required by law, or if we discontinue the Service. In the event of Service discontinuation, we will provide at least 30 days' notice by email to allow you to download your data.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania and applicable European Union regulations. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Romania.

If you are a consumer located in the EU, you may also have the right to submit disputes to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.

15. Miscellaneous

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Onbit Media SRL regarding the Service and supersede any prior agreements.

No Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce such provision in the future.

No Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
